Welcome to PersonalCareHomes.net (“PersonalCareHomes,” “we,” “us,” or “our”). These Terms & Conditions (“Terms”) govern your access to and use of the PersonalCareHomes.net website, including its directory, search tools, listings, contact forms, and related services (collectively, the “Site”).

By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.

1. About PersonalCareHomes.net

PersonalCareHomes.net is an online directory designed to help families and other users locate and learn about personal care homes, residential care homes, assisted living options, and related providers.

We are not a personal care home, assisted living facility, healthcare provider, medical provider, case manager, placement agency, emergency service, or insurer. We do not provide medical, legal, financial, or professional care advice.

Listings may be free, claimed, enhanced, featured, or otherwise paid for by a provider. A paid, featured, or enhanced listing does not mean that PersonalCareHomes.net endorses, certifies, recommends, inspects, or guarantees that provider.

2. No Medical, Care, or Placement Advice

Information on the Site is provided for general informational purposes only. It is not a substitute for professional medical, legal, financial, licensing, or care-planning advice.

You are responsible for evaluating any provider, including by:

  • Visiting the home or facility;
  • Speaking directly with the owner, administrator, and staff;
  • Confirming current licensing, credentials, availability, pricing, services, and staffing;
  • Reviewing any applicable inspection, complaint, or regulatory information; and
  • Consulting qualified professionals as appropriate for your situation.

Do not use the Site for emergencies. If you or another person is experiencing a medical emergency, call 911 or seek immediate help from a qualified emergency service.

3. Directory Listings and Accuracy

We make reasonable efforts to present useful directory information. However, provider information may change and may be incomplete, outdated, inaccurate, or supplied by a third party.

We do not guarantee the accuracy, completeness, availability, legality, quality, safety, suitability, licensing status, pricing, or services of any provider listed on the Site. The inclusion of a provider does not create a recommendation, referral, partnership, agency relationship, or approval by PersonalCareHomes.net.

You should contact a provider directly to confirm all information before making a care, financial, or placement decision.

4. Contacting Providers

The Site may allow you to contact a provider directly or submit an inquiry through a form. By submitting an inquiry, you authorize us to transmit the information you provide to the applicable provider or providers so they may respond to you.

We are not responsible for provider response times, communications, decisions, services, or any relationship between you and a provider. You should not submit protected health information, Social Security numbers, insurance identification numbers, financial account information, or other sensitive information through the Site unless we specifically request it through a secure process.

5. Provider and Listing Owner Terms

If you claim, create, manage, purchase, enhance, or otherwise control a listing, you represent and warrant that:

  • You have authority to act for the provider or business;
  • Information you submit is accurate, current, complete, and not misleading;
  • Your business complies with applicable laws, licensing requirements, advertising rules, and regulations;
  • You will promptly update information that changes, including contact information, services, pricing, availability, licensing, and ownership;
  • You have all rights and permissions needed to submit any text, logos, photographs, videos, reviews, or other content; and
  • Your listing content does not infringe another party’s rights or contain unlawful, deceptive, discriminatory, defamatory, or harmful material.

We may edit, reject, suspend, remove, or label any listing or content at our discretion, including where we believe it is inaccurate, unsafe, deceptive, unlawful, or inconsistent with these Terms. We are not required to publish or retain any listing.

6. Paid Listings, Plans, and Billing

Certain listing enhancements, featured placements, advertising opportunities, or other services may require payment. Pricing, included features, billing frequency, renewal terms, cancellation terms, and any applicable refund policy will be presented at checkout or in the applicable service agreement.

Unless otherwise stated at checkout or required by law:

  • Fees are due in advance;
  • Fees are non-refundable once a paid service period begins;
  • Recurring plans may renew automatically until cancelled; and
  • You are responsible for providing accurate and current payment information.

We may suspend or remove paid features if payment is declined, reversed, disputed, or overdue. Payment processing may be handled by a third-party processor and is subject to that processor’s terms and privacy practices.

7. User Conduct

You agree not to use the Site to:

  • Submit false, misleading, or fraudulent information;
  • Impersonate another person or business;
  • Harass, threaten, exploit, discriminate against, or harm another person;

By submitting listing content or other content to us, you grant PersonalCareHomes.net a non-exclusive, worldwide, royalty-free license to use, reproduce, display, adapt, publish, and distribute that content in connection with operating, promoting, and improving the Site and its listings.

The Site may contain links to third-party websites, service providers, maps, payment processors, social-media platforms, or other resources. We do not control and are not responsible for third-party content, availability, security, policies, products, or services.

WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

12. Limitation of Liability

13. Indemnification

You agree to defend, indemnify, and hold harmless PersonalCareHomes.net and its owners, officers, employees, contractors, and affiliates from claims, damages, liabilities, costs, and expenses arising out of or related to:

  • Your use of the Site;
  • Your violation of these Terms;
  • Content you submit to the Site;
  • Your interaction or agreement with a provider or another user; or
  • Your violation of any law or third-party right.

14. Changes to the Site or These Terms

We may modify, suspend, discontinue, or update the Site or these Terms at any time. The updated Terms will be posted on this page with a revised Effective Date. Your continued use of the Site after updated Terms are posted means you accept the changes.

15. Governing Law and Venue

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules. Any dispute arising from these Terms or use of the Site must be brought in a state or federal court located in Bexar County, Texas, unless applicable law requires otherwise.

16. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.
